By accessing and using TrailorNow ("we," "our," or "us"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

TrailorNow is an online marketplace that connects trailer owners with renters seeking to rent trailers for various purposes including moving, hauling, and transportation. We facilitate these connections but are not a party to the actual rental agreements between users.

3. User Accounts and Registration

3.1 Account Creation

To use certain features of our service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for safeguarding the password and for maintaining the security of your account. You agree not to disclose your password to any third party and to take sole responsibility for any activities or actions under your account.

4. User Responsibilities

4.1 For Trailer Owners (Listers)

• Provide accurate and truthful descriptions of trailers
• Ensure trailers are in safe, working condition
• Maintain proper insurance coverage
• Comply with all local, state, and federal regulations
• Respond promptly to rental inquiries

4.2 For Renters

• Use trailers only for lawful purposes
• Operate trailers safely and responsibly
• Return trailers in the same condition as received
• Carry appropriate insurance coverage
• Pay all fees and charges promptly

5. Prohibited Uses

You may not use our service:

• For any unlawful purpose or to solicit others to perform unlawful acts
• To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
• To infringe upon or violate our intellectual property rights or the intellectual property rights of others
• To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
• To submit false or misleading information
• To engage in any automated use of the system

6. Payments and Fees

TrailorNow charges service fees for facilitating rental transactions. All fees are clearly disclosed before completing any transaction. Payment processing is handled by third-party payment processors, and you agree to their terms of service.

6.1 SMS Messaging

By providing a mobile phone number and opting in during registration or booking, you agree to receive automated and live SMS messages from TrailorNow related to your account, bookings, and important service updates. Standard message and data rates may apply. You can opt out anytime by replying "STOP" to any message. For help, reply "HELP" or contact our support team. Message frequency varies based on your rental activity.

7. Insurance and Liability

Users acknowledge that TrailorNow is not responsible for any damages, injuries, or losses arising from trailer rentals. All rental agreements are between users, and TrailorNow disclaims liability for any issues arising from these transactions.

8. Dispute Resolution

While we provide a platform for communication between users, TrailorNow is not responsible for resolving disputes between renters and owners. We encourage users to resolve disputes amicably and may provide assistance in facilitating communication.

9. Intellectual Property Rights

The service and its original content, features, and functionality are and will remain the exclusive property of TrailorNow and its licensors. The service is protected by copyright, trademark, and other laws.

10. Privacy Policy

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the service, to understand our practices.

11. Termination

We may terminate or suspend your account and bar access to the service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever including but not limited to a breach of the Terms.

12. Disclaimer

The information on this website is provided on an "as is" basis. To the fullest extent permitted by law, this Company excludes all representations, warranties, conditions and terms related to our website and the use of this website.

13. Limitation of Liability

In no event shall TrailorNow, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

14. Governing Law

These Terms shall be interpreted and governed by the laws of the State of California, without regard to conflict of law provisions. Any disputes arising from these Terms or your use of our service shall be resolved in the state or federal courts located in California.

15. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.
